10% Abandoned Cart Discount Code – drsimi.com

These Promotional Terms & Conditions apply to the 10% Abandoned Cart Discount Code (the “Promotion”) organized by Farmacias de Similares TX LLC dba Dr. Simi (the “Sponsor”), a company operating e-commerce sales through its official U.S. online storefront at drsimi.com, with its principal U.S. office at 800 Brazos St., Suite 260 Austin, TX 78701.  

 

This promotion (the “Promotion”) is valid during December 2025, and throughout all of calendar year 2026 (the “Promotional Period”). The Promotion is offered exclusively through drsimi.com for online purchases shipped within the United States, excluding Alaka, Hawaii, Puerto Rico and U.S Territories. 

 

The Promotion is governed by the laws of the State of Texas and applicable U.S. federal regulations, including those relating to consumer protection, e-commerce, and promotional advertising.  

 

  

1. Promotion Details 

This campaign offers existing customers the opportunity to receive a ten percent (10%) discount (the “Discount”) on eligible purchases on drsimi.com, by using a discount code (the “Discount Code”) provided to the customer via email following an abandoned cart event. 

For purposes of this Promotion, an “Abandoned Cart” occurs when: 

1. A customer adds one or more eligible products to their shopping cart on drsimi.com; and 

2. The customer does not complete checkout within a reasonable time as determined by the Sponsor’s e-commerce platform; and 

3. The customer has provided a valid email address and has not opted out of receiving marketing or transactional communications from the Sponsor. 

For abandoned carts that meet the above conditions, the Sponsor will send automated email communications to the customer, subject to technical and operational limitations of the email and e-commerce systems: 

  • Email 1 (Reminder): An initial abandoned cart reminder email may be sent within a reasonable period after the cart is abandoned. 

  • Email 2 (Discount Offer): A second abandoned cart email is scheduled to be sent approximately twenty-four (24) hours after the cart is abandoned. This second email will include a ten percent (10%) Discount Code for use on eligible products on drsimi.com. 

The Discount will apply when the customer enters the Discount Code at checkout during the Promotional Period, provided that: 

  • The purchase is completed on drsimi.com; and 

  • The products in the cart are eligible for this Promotion; and 

  • All other conditions set out in these Terms & Conditions are met. 

The Discount is calculated based on the regular, non-promotional price of each eligible product in the customer’s order, before taxes, shipping, and other fees. The Discount does not apply to shipping charges, taxes, or any other non-product fees. The Promotion is intended for consumer purchases only. 

Any product or service eligible for reimbursement by insurers, PBMs, Medicare, Medicaid, TRICARE, or any other healthcare payor is excluded from this Promotion. These exclusions are mandated under federal healthcare regulations prohibiting inducements related to reimbursable medical goods or services. This Promotion does not apply to OTC medicines, Eternal Secret products, ‘X Gear’ items, or any plush or merchandise items (including keychains, plush toys, socks, and similar accessories). 

The Sponsor does not guarantee that every abandoned cart will result in the generation or successful delivery of an email containing the Discount Code, as delivery is subject to technical factors such as email deliverability, spam filters, system outages, and customer communication preferences. 

 

2. Eligibility 

This offer is open to customers who are eighteen (18) years of age or older at the time of participation. 

Participation is limited to individual consumers and does not extend to wholesalers, distributors, or resellers. 

The Promotion is valid only for orders placed on drsimi.com during the Promotional Period and shipped to a valid address within the United States (including the District of Columbia). 

To receive the Discount Code, the customer must: 

1. Have created an abandoned cart with at least one eligible product on drsimi.com; and 

2. Have provided a valid email address; and 

3. Not have unsubscribed or opted out from receiving email communications from the Sponsor at the time the abandoned cart emails are processed. 

The Sponsor reserves the right to verify eligibility and may refuse, cancel, or restrict the use of the Discount Code in cases of suspected fraud, abuse, or any conduct that compromises the integrity of the Promotion. 

 

3. Conditions 

This promotional offer may be combined with other compatible discounts, coupons, loyalty benefits, or marketing incentives, unless a specific promotion is expressly labeled as non-combinable or technical limitations prevent stacking at checkout. If a conflict arises between promotions, the system will apply the highest eligible discount according to the rules defined by the Sponsor. 

Availability may vary depending on inventory and logistics. The Sponsor makes every effort to keep eligible products in stock throughout the Promotional Period but does not guarantee uninterrupted supply. 

The availability of participating products is strictly subject to the inventory available at the time of purchase. If a product is out of stock, the Promotion will not apply to that item. No substitutions, replacements, vouchers, equivalent benefits, or post-purchase adjustments will be offered. The Sponsor does not guarantee the continuous availability of any participating product during the Promotional Period. 

The Sponsor may modify, suspend, or terminate this Promotion at any time, in whole or in part, due to operational circumstances, stock limitations, system outages, cybersecurity incidents, or external factors such as regulatory changes, force majeure events, or supply chain disruptions. Any such modifications will take effect immediately and without prior notice but will not affect customers who have already completed qualifying purchases or who have already redeemed a valid Discount Code. 

Any modification to this Promotion will apply only prospectively and will not affect customers who have already completed qualifying purchases prior to the effective date of the modification. 

Nothing in these Terms & Conditions shall limit any statutory consumer rights under applicable U.S. federal or Texas law. 

Images or product representations used in promotional materials are for illustrative purposes only and may not precisely reflect the actual packaging or configuration of the items offered. 

The Promotion excludes OTC medicines, Eternal Secret products, ‘X Gear’ items, or any plush or merchandise items (including keychains, plush toys, socks, and similar accessories) and any product eligible for reimbursement by insurers, PBMs, Medicare, Medicaid, TRICARE, or any other health payor. Products purchased under this Promotion are intended solely for e-commerce, non-reimbursable consumer use and may not be billed, directly or indirectly, to any private or federal health program. 

The Sponsor may reject, cancel, or suspend any transaction when there are risks of fraud, system manipulation, atypical purchasing patterns, security measures, regulatory requirements, or any other circumstances that may compromise the integrity of the Promotion or applicable regulatory compliance. The Sponsor also reserves the right to cancel or refuse the use of any Discount Code in cases of suspected fraud, abuse, or violation of these Terms & Conditions. 

To the extent permitted by law, all purchases made under this Promotion, including items on which the Discount Code is applied, are final and are not eligible for returns, refunds, or exchanges, except where required under applicable U.S. consumer protection law or under the return policy expressly stated on drsimi.com at the time of purchase. 

 

4. Disclaimer 

This Promotion is intended strictly for e-commerce consumer purchases. Products obtained under this offer are not for resale or redistribution, and the Sponsor reserves the right to take appropriate legal or commercial action if misuse is detected. 

All participating products — including dietary supplement items — comply with applicable U.S. labeling, packaging, and marketing regulations. Nonetheless, customers are reminded that dietary supplements are not intended to diagnose, treat, cure, or prevent any disease, and should be used according to label instructions. Customers are encouraged to review ingredient information and consult a qualified professional if they have specific health conditions or concerns before use. 

Any personal data collected during participation in the Promotion will be processed in accordance with drsimi.com’s Privacy Policy and applicable Texas and U.S. privacy laws. If, for verification, fraud prevention, or operational control purposes, additional consumer information is collected or processed, such processing will be carried out in accordance with applicable privacy laws and disclosed through the corresponding Notice at Collection, available upon request or through the channels designated by the Sponsor. 

By participating in this Promotion, customers acknowledge that they have read and fully accepted these Terms & Conditions, including all limitations and requirements. Participation constitutes consent to abide by drsimi.com’s policies and all applicable laws governing promotional activity in the United States. 

 

5. Governing Law 

This Promotion and any related disputes shall be governed by the laws of the State of Texas and applicable U.S. federal regulations, particularly those concerning advertising practices, consumer protection, e-commerce, and promotional integrity. Any dispute or claim arising in connection with this campaign will be subject to the exclusive jurisdiction of the competent courts located in Harris County, Texas, except where otherwise required by consumer protection law.  

 

6. Dispute Resolution 

In the event of a dispute, the parties agree to first attempt resolution through mediation in Harris County, Texas before pursuing litigation. If mediation is unsuccessful, any action shall be brought before the competent courts of Harris County, Texas, unless otherwise required by consumer protection law.
