DRSIMI.COM – PROMOTIONAL TERMS & CONDITIONS

These Promotional Terms & Conditions apply to the Buy Any Product, Get One Free Surprise Multigomi Gift promotion organized by Farmacias de Similares TX LLC dba Dr. Simi (the “Sponsor”), a company operating e-commerce sales through its official U.S. online storefront at drsimi.com.

 

This promotion (the “Promotion”) is valid from May 26, 2026, at 12:01 a.m. (Central Time) until officially terminated by the Sponsor or while supplies last, whichever occurs first. Termination notice will be posted online or through the applicable promotional channels at least five (5) business days in advance whenever operationally practicable (the “Promotional Period”). The Promotion is offered exclusively through drsimi.com for online purchases shipped within the United States.

 

The Promotion is governed by the laws of the State of Texas and applicable U.S. federal regulations, including those relating to consumer protection, e-commerce, promotional advertising, dietary supplements, and healthcare-related inducement restrictions.

 

1. Promotion Details

This campaign offers customers the opportunity to receive one free surprise Multigomi gift in the same online transaction when purchasing any product on drsimi.com, with no minimum purchase amount required, excluding any product or service eligible for reimbursement by insurers, PBMs, Medicare, Medicaid, TRICARE, or any other healthcare payor.

The gift will be selected by the Sponsor from the participating gift products listed in Exhibit A, subject to online availability. Customers may not choose, exchange, substitute, or request a specific gift. The one (1) gift may consist of either participating gift product, depending on inventory availability at the time the order is processed.

The gift does not apply to restricted or reimbursable items, prescription items, products or services prohibited under federal or state healthcare inducement rules, or any other excluded product identified by the Sponsor.

The gift is automatically applied at checkout once the system detects the purchase of any eligible product in the same online order. No coupon, registration, or additional action is required.

The Promotion applies only to items available for sale during the Promotional Period and to the participating gift products described in Exhibit A, which forms an integral and enforceable part of these Terms & Conditions.

 

2. Eligibility

This offer is open to customers who are eighteen (18) years of age or older at the time of purchase.

Participation is limited to individual consumers and does not extend to wholesalers, distributors, or resellers.

The offer is valid only during the designated Promotional Period or while supplies last, whichever occurs first.

The Sponsor reserves the right to verify eligibility, cancel an order, or deny participation if irregularities are detected — including but not limited to fraudulent behavior, abusive purchasing patterns, automated purchasing bots, or any conduct that compromises the integrity of the Promotion.

 

3. Conditions

This promotional offer may be combined with other promotions, discounts, coupons, loyalty benefits, or marketing incentives, provided that all applicable requirements for each promotion are independently satisfied and the combination is not prohibited by the Sponsor, applicable law, or healthcare compliance restrictions.

Availability may vary depending on online inventory and logistics. The Sponsor makes every effort to keep eligible products in stock throughout the Promotional Period but does not guarantee uninterrupted supply.

The availability of the qualifying purchase and participating gift products is strictly subject to the inventory available online at the time of purchase or order processing. If any participating gift product is out of stock, the Sponsor may provide another participating gift product, limit the Promotion, suspend the Promotion, or terminate the Promotion. No substitutions, replacements, vouchers, equivalent benefits, cash equivalents, or post-purchase adjustments will be offered.

The Sponsor may modify, suspend, or terminate this Promotion at any time, in whole or in part, due to operational circumstances, stock limitations, system outages, cybersecurity incidents, or external factors such as regulatory changes, force majeure events, or supply chain disruptions. Any such modifications will take effect immediately and without prior notice but will not affect customers who have already completed qualifying purchases.

Any modification to this Promotion will apply only prospectively and will not affect customers who have already completed qualifying purchases prior to the effective date of the modification.

Nothing in these Terms & Conditions shall limit any statutory consumer rights under applicable U.S. federal or Texas law.

This Promotion may not be used, directly or indirectly, in connection with any product eligible for reimbursement by private insurers or federal or state health programs (including, without limitation, Medicare, Medicaid, TRICARE, or PBMs). This Promotion shall not be interpreted as an incentive, benefit, or economic advantage related to the purchase, recommendation, or handling of reimbursable products.

Products sold under this offer are intended solely for retail, non-reimbursable consumer use and may not be billed, directly or indirectly, to any private or federal health program.

The Sponsor may reject, cancel, or suspend any transaction when risks of fraud, system manipulation, atypical purchasing patterns, security measures, regulatory requirements, or any other circumstances that may compromise the integrity of the Promotion or applicable regulatory compliance are identified.

All purchases made under this Promotion are subject to Dr. Simi’s standard return and refund policies, except where required under Texas or applicable U.S. consumer protection law. If a customer returns the purchased product, the customer is not required to return the gift, and the value of the gift will not be deducted from the refund, except in cases of suspected fraud, abuse, system manipulation, or other misuse of the Promotion.

 

4. Disclaimer

This Promotion is intended strictly for retail consumer purchases. Products obtained under this offer are not for resale or redistribution, and the Sponsor reserves the right to take appropriate legal or commercial action if misuse is detected.

5. Governing Law

This Promotion and any related disputes shall be governed by the laws of the State of Texas and applicable U.S. federal regulations, particularly those concerning advertising practices, consumer protection, e-commerce, and promotional integrity.

Any dispute or claim arising in connection with this campaign will be subject to the exclusive jurisdiction of the competent courts located in Harris County, Texas, except where otherwise required by consumer protection law.

 

6. Dispute Resolution

In the event of a dispute, the parties agree to first attempt resolution through mediation in Harris County, Texas before pursuing litigation. If mediation is unsuccessful, any action shall be brought before the courts of Harris County, Texas, unless otherwise required by consumer protection law.
