1. Scope and Overview

This Privacy Notice explains how Farmacias de Similares TX LLC (“Company,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with the Mexico–U.S. Referral Program and all related U.S. activities. It applies to all individuals located in the United States whose personal information we collect, regardless of the state of residence.

2. Categories of Personal Information We Collect

We may collect the following categories of personal information, as defined under applicable U.S. state privacy laws:

  • Identifiers: name, email address, telephone number.
  • Referral Program Data: unique referral codes, records of referrals sent and accepted.
  • Internet Activity: IP address, device identifiers, browser type, usage data, and preferences.
  • Marketing Preferences: opt-in choices for email, SMS, and WhatsApp communications.

We do not knowingly collect sensitive personal information as defined by state privacy laws.

3. Sources of Information

  • Directly from you when you register or participate in the referral program.
  • Automatically from your device when you visit our websites or interact with our messages.
  • From service providers and vendors supporting the program (e.g., CRM, cloud hosting, messaging platforms).

4. Purposes of Processing

We use personal information to:

  • Operate and manage the referral program.
  • Generate and validate referral codes and award prizes for the Mexico based participants.
  • Detect and prevent fraud or misuse.
  • Provide customer service and respond to inquiries.
  • Send marketing communications where you have provided prior consent (e.g., SMS or WhatsApp).
  • Comply with legal obligations and enforce our terms.

5. Selling or Sharing of Personal Information

  • No Sale: We do not “sell” personal information as that term is defined under California’s CCPA/CPRA or other state privacy statutes.
  • Cross-Context Behavioral Advertising: If we “share” information for cross-context behavioral advertising, you may opt out at any time via the “Do Not Sell or Share My Personal Information” link on our website, and we honor Global Privacy Control (GPC) signals.

8. Minors

Our referral program is intended for individuals 18 years and older. We do not knowingly collect personal information from children under 13. If we learn that we have done so, we will delete it in accordance with the Children’s Online Privacy Protection Act (COPPA).

9. Service Providers and Transfers

We share information only with service providers and contractors who process data on our behalf under written agreements that require them to protect personal information and use it solely for the contracted services. Where data is transferred internationally (e.g., to Farmacias de Similares, S.A. de C.V. in Mexico), we implement appropriate safeguards consistent with applicable privacy laws.

10. Security

We implement reasonable physical, technical, and administrative safeguards designed to protect personal information against unauthorized access, use, or disclosure.

We may update this Privacy Notice from time to time. The “Effective Date” at the top indicates when it was last revised. Material changes will be posted on our website with a revised date.

Referral Code Terms – U.S. Site

Sponsor: Farmacias de Similares TX LLC, 800 Brazos St, Suite 260, Austin, TX 78701, USA (“we,” “our,” “us”).

This Referral Code program forms part of the Mexico–U.S. Referral Program coordinated with Farmacias de Similares, S.A. de C.V. in Mexico, effective from November 1 to November 30, 2025.

1. What the Referral Code Is

The referral code (“Code”) is a tracking identifier created by Farmacias de Similares, S.A. de C.V. in Mexico as part of its Mexico-based referral program.
It allows a participant in Mexico (the “Referrer”) to receive credit toward a prize offered and fulfilled only in Mexico.
The Code itself does not provide any discount, reward, or contest entry to the person making a purchase on this U.S. site.
The Referrer must be an eligible employee or participant registered in Mexico under the official terms of the program. The U.S. purchaser does not become a participant or beneficiary under those Mexican terms.

2. How the Code Is Generated and Shared

  1. A customer located in Mexico registers for the referral program by scanning a QR code and providing their name, email address, and telephone number on a Mexican registration page.
  2. After registration, that customer automatically receives a unique Code by email.
  3. The customer in Mexico may share the Code privately with friends or family members who live in the United States, typically through email, WhatsApp, or other direct messaging.

3. How You (the U.S. Purchaser) Use the Code

  • When you shop on DrSimi.com (U.S. site), you may enter the Code during checkout in the field labeled “Referral Code.”
  • Entering the Code simply lets us record that your purchase originated from that Mexican participant’s referral so that the Referrer can receive credit in Mexico.
  • Your order, price, and available promotions remain exactly the same whether or not you use the Code.
  • Only purchases of USD $25 or more qualify to generate referral credit in Mexico. However, purchases of a lower value may accumulate fractional credit that will be rounded and applied once the equivalent of USD $25 has been reached.

Purchases of prescription drugs or any items reimbursed by federal or state health care programs or commercial third-party payors are excluded from the referral tracking and do not generate credit for the Mexican participant.

4. No U.S. Prize or Promotion

  • Entering a Code does not enroll you in any contest, sweepstakes, or loyalty program in the United States.
  • No prize, rebate, or reward is offered to U.S. customers for using a Code.
  • All prizes and incentives are managed and awarded exclusively in Mexico by Farmacias de Similares, S.A. de C.V.

5. Privacy

When you enter a Code, we record it together with your purchase details to link the sale to the Mexican participant.

6. Limitation of Liability

Use of a Code does not create any contractual relationship between you and Farmacias de Similares, S.A. de C.V. in Mexico.

Farmacias de Similares TX LLC is responsible only for processing your purchase on DrSimi.com and for protecting your personal information as described in the U.S. Privacy Notice.

7. Changes or updates

Program Updates. Farmacias de Similares TX LLC may update these Referral Code Terms as needed to align with modifications made to the Mexico-based program. Any material updates.

8. Governing Law

These terms are governed by the laws of the State of Texas and applicable federal laws of the United States, without regard to conflict-of-law principles.

Any disputes related to the use of a referral code on this U.S. site will be resolved exclusively in the state or federal courts located in Travis County, Texas.
