NEVADA CONSUMER HEALTH DATA PRIVACY NOTICE

This website is owned and operated by Farmacias de Similares TX LLC dba Dr. Simi, a Texas limited liability company. 
Farmacias de Similares TX LLC (hereinafter referred to as “the Company,” “we,” “our,” or “us”) use cookies and similar tracking technologies on our website to improve user experience, analyze website traffic, and provide personalized content. “Our Site" means our websites, emails, apps, and other services that link to this Consumer Health Data Privacy Act. 
This Consumer Health Data Privacy Notice supplements our Privacy Notice and applies solely to personal information defined as “consumer health data” (“CHD”) subject to the Nevada Consumer Health Data Privacy Act. CHD includes certain personal information of 1) residents of the State of Nevada; and/or 2) individuals whose consumer health information is collected in the State of Nevada (collectively “you” or “consumers”).
This notice describes how we collect consumer health data from or about these consumers from any source, including its online services and in store.  
By using our website, you acknowledge that you have read and understood this Consumer Health Data Privacy Notice and consent to the collection and use of your consumer health data as described herein.
1.    What is Consumer Health Data?
“Consumer Health Data,” as defined by the Nevada Consumer Health Data Privacy Act, means personally identifiable information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status or that is used to identify health status. CHD can include:
•    Any health condition or status, disease, or diagnosis. 
•    Social, psychological, behavioral, or medical interventions. 
•    Surgeries or other health-related procedures. 
•    The use or acquisition of medication. 
•    Bodily functions, vital signs, or symptoms. 
•    Reproductive or sexual health care. 

2.    Consumer Health Data We Collect

As described in our Privacy Notice, the CHD we collect depends on how you interact with our websites and services. Because CHD is broadly defined, many of the categories of data we collect could also be considered CHD. For example, CHD may include: 

•    Information about your health-related conditions, symptoms, status, diagnoses, testing, or treatments (including surgeries, procedures, medications, or other interventions). For example, we may collect such information through surveys or other communication with you for research studies and improving product accessibility.
•    Measurements of bodily functions, vital signs, or characteristics, including photographs, which may also be considered biometric information under the Nevada Consumer Health Data Privacy Act or other applicable state consumer health privacy law.
•    Precise location information that could reasonably indicate your attempt to acquire or receive health services or supplies. For example, if you use Bing maps to get directions to a health care provider, we may collect GPS, cell tower, and Wi-Fi hotspot location data that could reveal health-related information.
•    Information that could identify your attempt to seek health care services or information, including services that allow you to assess, measure, improve, or learn about your or another person’s health. For example, we collect your Bing search queries, which may include queries concerning nutrition, wellness, fitness, medical conditions, or other health-related topics.
•    Other information that may be used to infer or derive data related to the above or other health information. 

3.    Sources of CHD
As described in the “Information We Collect” section of our Privacy Notice, we collect personal information (which may include CHD) directly from you, from your interactions with our products and services, from third parties, and from publicly available sources. 

4.    How We Use CHD
We use CHD for the purposes described in the “How We Use Your Information” section of our Privacy Notice. Primarily, we collect and use consumer health data as reasonably necessary to provide you with the products you have requested or authorized. This may include delivering and operating the products and their features, personalization of certain product features, ensuring the secure and reliable operation of the products and the systems that support them, troubleshooting and improving the products, and other essential business operations that support the provision of the products (such as analyzing our performance, meeting our legal obligations, developing our workforce, and conducting research and development).
We may use CHD for other purposes for which we give you choices and/or obtain your consent as required by law; for example, for advertising or marketing purposes. See the “Your Privacy Rights” section of our Privacy Notice and the “How to Exercise Your Rights” section below.
 
5.    How We Share CHD
We may share each of the categories of CHD described above for the purposes described in the “How We Share Your Personal Information” section of our Privacy Notice. In particular, we may share personal data, including CHD, with your consent or as reasonably necessary to complete any transaction or provide any product you have requested or authorized, as described above.
5.1    Third Parties With Whom We Share CHD
As necessary for the purposes described above, we share CHD with the following categories of third parties:
•    Service providers. Vendors or agents working on our behalf may access CHD for the purposes described above. For example, payment processors, shipping carriers, and IT and cybersecurity service providers. 
•    Business partners. We may share CHD with other companies. For example, where you use our services to interact with another company.
•    Financial institutions & payment processors. When you make a purchase or enter into a financial transaction, we will disclose payment and transactional data to banks and other entities as necessary for payment processing, fraud prevention, credit risk reduction, analytics, or other related financial services.
•    Parties to a corporate transaction. If the Company and its affiliates undergo a merger, acquisition, or sale of assets, CHD may be transferred to the new entity as part of the business transition.
•    Affiliates. We enable access to data across our subsidiaries, affiliates, and related companies, for example, where we share common data systems or where access helps us to provide our services and operate our business. 
•    Law Enforcement and Government Agencies. We may disclose CHD if required by law, if necessary to comply with a legal request (e.g., a subpoena or court order), or to protect our rights, property, or customer safety. 
•    Other users and individuals. If you use our services to interact with other users of the service or other recipients of communications, we will share data, including CHD, as directed by you and your interactions.
•    The public. You may select options available through our services to publicly display and disclose certain information, such as your profile, demographic data, content and files, or geolocation data, which may include CHD.

6.    How to Exercise Your Rights

If you are covered by the Nevada Consumer Health Data Privacy Act, you may have certain rights with respect to CHD, including the rights to access, delete, correct, or withdraw consent, subject to certain exceptions. You can require to exercise such rights using the mechanisms described in the “Exercising Your Privacy Rights” section of our Privacy Notice.
